Un tribunal federal neg\u00f3 un\u00a0amparo\u00a0al capit\u00e1n de infanter\u00eda\u00a0Jos\u00e9 Mart\u00ednez Crespo, preso desde noviembre de 2020 en el\u00a0Campo Militar 1-A\u00a0por su presunta implicaci\u00f3n en el\u00a0caso Ayotzinapa, que en septiembre pr\u00f3ximo cumple doce a\u00f1os.<\/p>\n\n\n\n
El primer\u00a0militar detenido\u00a0por este caso recurri\u00f3 a la protecci\u00f3n de la\u00a0justicia federal\u00a0luego de que una jueza de Distrito llevara al \u00e1mbito federal la causa penal en la que se le acusa del delito de\u00a0desaparici\u00f3n forzada\u00a0de personas, en el que se contempla una pena m\u00e1s severa.<\/p>\n\n\n\n
A Mart\u00ednez Crespo, quien fuera uno de los mandos del 27 Batall\u00f3n de\u00a0Iguala, se le dict\u00f3 auto de formal prisi\u00f3n por desaparici\u00f3n forzada en agravio de los\u00a043 normalistas, conforme a la ley en la materia del estado de\u00a0Guerrero\u00a0que establece entre 30 y 50 a\u00f1os de c\u00e1rcel para quien comete este delito con la agravante de que la v\u00edctima haya sido torturada y se le provoque la muerte.<\/p>\n\n\n\n
Sin embargo, en julio de 2024, la jueza Segundo de Distrito de Procesos Penales Federales en el Estado de M\u00e9xico traslad\u00f3 el asunto bajo Ley General en Materia de Desaparici\u00f3n Forzada de Personas, Desaparici\u00f3n cometida por particulares y del Sistema Nacional de B\u00fasqueda de Personas, que contempla de 40 a 70 a\u00f1os de prisi\u00f3n por el delito de desaparici\u00f3n forzada de personas, y que entr\u00f3 en vigor en enero de 2018.<\/p>\n\n\n\n
