La ministra Norma Luc\u00eda Pi\u00f1a Hern\u00e1ndez, presidente del Poder Judicial de la Federaci\u00f3n, someti\u00f3 a consulta de las y los integrantes del Pleno de la Suprema Corte de Justicia de la Naci\u00f3n (SCJN), la solicitud de la Consejer\u00eda Jur\u00eddica del Ejecutivo Federal de no resolver la acci\u00f3n de inconstitucionalidad 29\/2023 y sus acumuladas, hasta en tanto no se pronuncie sobre otra acci\u00f3n presentada en 2018, en contra del decreto por el que se expide la Ley General de Comunicaci\u00f3n Social.
Al respecto, las 11 ministras y ministros determinaron por unanimidad que no es factible atender dicha petici\u00f3n, ya que la impugnaci\u00f3n presentada en 2023 se list\u00f3 con fecha fija para el pr\u00f3ximo lunes 8 de mayo, en t\u00e9rminos de la legislaci\u00f3n aplicable, toda vez que se ha tramitado con el car\u00e1cter de electoral.
El Pleno consider\u00f3 que el an\u00e1lisis que comenzar\u00e1 el pr\u00f3ximo lunes no provocar\u00e1 el dictado de sentencias contradictorias ni afectar\u00e1 los principios de seguridad y certeza jur\u00eddica, ya que en este asunto se impugnaron procedimientos legislativos que son distintos a los controvertidos en 2018, a pesar de que se trate de la misma norma (Ley General de Comunicaci\u00f3n Social).
Asimismo, el proyecto relativo a la acci\u00f3n de inconstitucionalidad 52\/2018 y sus acumuladas -a la cual no se le dio el tr\u00e1mite de materia electoral-, no ha sido entregado a la Secretar\u00eda General de Acuerdos de la SCJN.
